I've read a lot of post on this board and I'm finally learning something. You don't apparently understand a good informative post. Pay attention, you might learn something. Thanks again, Salmo g

Not to worry, I'll keep my stomping to people who call me names. Or just ignore them. That works better. You know how hard it is to scrape off all that yuck from my shoes? As for the shouts I was being sarcastic about all the people who yell for rights and the like. I only metioned the state rights part as a hopeful item that could happen here.

I know that we have to honor the treatys that were signed 100 years ago.But I'm sure that they didn't say they good just slaughter fish and game animals(elk) just because they can.I have pictures that I took of thousands of dead chum salmon on the beach at hoodsport that they threw there and took just the hens for there eggs just because they could, I have seen the pictures of elk that were shot and left laying where they were because they were to far from the road to pack out JUST BECAUSE THEY GOOD !!!.I will never belive that was the intent of the treatys.I also believe that the white man is every bit as guilty as the indians in doing the same thing. (ex. Buffalo) but that doesn't mean it should be allowed to go on.Those treatys were signed a long time ago and times have changed. We keep getting less and less for our dollars as sportsman and it seems like they just keep takeing more BECAUSE THEY CAN.They fish for subsistance thats what I hear all the time, well they now have all these gambleing casinos that there makeing all this money on and now cig. factories being built so they don't really need to fish for subsistance anymore and maybe they should start following the same rules we follow.I also believe that we need to get the gillnetters off the rivers they are not all the blame but they share a good part of it along with dams and farming and logging and yes us.I'm sorry but what is wrong is wrong and they should be stopped from doing it just because they can.I hads hopes of fishing when I retire in two years the way way things are going I'll be takeing my grandson to canada or alaska to fish instead of right here in my own home state.AND I BELIEVE THAT WE DO HAVE RIGHT TO FISH AND HUNT AS AMERICAN CITZENS AND THEY BETTER NEVER TRY TO TAKE THAT AWAY.THATS WHAT OUR ANCESTORS FOUGHT FOR AND I HOPE THATS WHAT WE FOUGHT FOR, OUR RIGHTS AS AMERICAN CITZENS.ANYWAY THATS HOW I FEEL
JUST BECAUSE I CAN.....

Guess i can't really let the Indian thing go without one last thought. For all our liberalism, I for one, who has spent time on reservations, has to wonder. Are our liberal laws and ways of thinking best for Indians? I mean first allowing them their fishin rights and tax free crap and casinos, basically allowing them sovereign nation status but giving them money and "special rights". I mean drive thru Tulalip or Taholah look at what the hell is happening. For the number of indians there are, one hell of a high percentage live in squallor.
They can have their treaty rights and anything else they want (cept my or my neighbors land) for all I care but kiss my ass if that is going to blind me from the reality of the native ghetto. (I aint sayin all just an inordinant percentage). It is liberal thinkers that created the cycle of the welfare state and that is all we are doing with the indians as far as I can see. I dont know what they do with the money they make off fishin but it sure as hell aint into haulin out junk cars and buyin paint, oh i forgot the Government has to paint their houses cuz our great grandfathers took their land, oops. Yeah that is pride I forgot. You liberals need to give them more money and rights, sure has helped them up to now, idiot enablers. C

Great topic, you are correct on the fact that treaties as a matter of law cannot be overuled by courts states or federal governments. Whomever said treaties could not be 'amended' is not correct. Treaties are superseded all the time. there are numerous treaties between the US and other countries concerning varous topics. Yesterday I was reading a 'new' treaty between the US and Ireland. The problem is you need both sides to be willing to supersede the original.
For this to happen, ie for the Native Americans to give up their right to net during certain times of the year, the government of our great state will need to give something up/back to them. In any event the biggest obstacle to such a task is the animosity between the parties at this point. Nevertheless, it seems to me that one would not have to offer up all that much to get the nets out of the river say from Feb 1 through April or whatever time frame is necessary to save the native steelhead. How much is anyone really benefiting from putting nets in at this point anyway? If the fish are being sold for bait ( i am getting sick) there seems to be some economics in favor of superseding/amending the treaty in regards to this topic.

We just need to hope that a new generation of leaders (on both sides) will see the light and fix this situation.

Is the United States the only nation in the world that observes treaties with its citizens? What is the usual consequence for the violation of a treaty? Is not the treaty held null and void by either side?
