Why do Indians have rights to state hatchery fish? Also, is there anyway to find out why they are allowed to abuse the decision to let them net, when Washington sportsmen have to pick up the cost to rebuild salmon habitat and population?

i do think it is ok for them to net but only the bigger ones get caught and the smaller ones go by and in turn the small fish breed smaller fish.

Its called the Orrick Decision http://www.kohary.com/env/quinault.htm Also the Puyallup Tribe releases fish from their Diru Creek hatchery, should sporties not be able to catch these? Can you tell the difference between a Diru Creek fish and a Voights creek fish? Oh yeah, and the tribe fought Puget Power to open fish passage over the Electron Dam, when DFW and the feds wouldn't put up a fight... http://www.enn.com/news/enn-stories/2000/10/10272000/salmonladder_39608.asp?site=email

First off, hobiecat, small fish don't always breed small fish. If you want to go that route, how can midgets have full sized kids? Nature is nature.
Onto netting. Though it burns my chaps on more then one occasion plunking the puyallup the last 25+ years, it's their right. But I will add, there are alot FEWER netters in the river. And just because they're in doesn't mean you can't fish. They can't foul your lines. Most will work around you. In years past people still get fish (and big ones to boot) even while nets are in. Back in the day, when you'd have a good 50 boats netting, you were SOL getting anything.
If you want to blame anyone on what's going on, in long run it's the people who made the deals years ago. Someone negotiated this deal in first place. I don't agree with it, but it was a deal. Now, would I like to see some changes? HELL YES! Only time will tell. I do believe at this rate alot of the Indians (most I've went to school with or know growing up near) will be working at Bingo halls and casino's. Much better money to be made there then fishing. Hope the trend continues. I know for a fact there is not anywhere near the nets in river of years past.

As far as the indians hatchery, it is my opinion that thay should net the stuck and fish the puyallup like everyone else (rod and reel). I know this will not happen because of decisions made in the past. As far as the fish ladder, PSE paid 2 mil for supplies and pays 175,000 to the puyallup indians annually to maintain the fish runs. So in my opinion they landed themselves a very high paying source of income.

My point is that its silly to say tribes shouldn't be allowed to fish salmon from state hatcheries or say that the state is the only entity doing anything for salmon. PSE would never have spent the money to build a fish ladder if the tribe hadn't threatened to sue them, they hadn't for 90 years and then suddenly when they settle with the tribe, they decide to build one. PSE is paying because they're the ones that screwed it up in the first place. Tribes released 30 million salmon last year.

The tribe is also running it's own fisheries dept. They do most of all the fish counts on the Puyallup so the state can do a few other tests there. One thing different this year is the tribe is buying the salmon from their mambers for a buck a pound. Still not sure why, but it has put more netters on the river this year than the last several. Most of the fish on the river are both state and tribal fish. They release around the same. Somewhere around two million smolt each if I remember right. If you land a wild or unclipped silver, it is most likely a White river native. They are getting about 300 fish a day to their up river traps.

SH69-Judge Bolt made the decission!!!!and to top it off he was bedding with an indian at the time so go figure!!
as far as nets 5 days and rod and reel 2 days were is our 50%..All you Indian lovers tell me if the puyallup's release there hatchery fish in the system why should'nt we be able to catch them? They have NETTED our fish for years..
CONQUERED NATION!!!! tell me this how does that work a nation inside a nation yet use our government money and OUR resources..
Maybe some of the tree huggers should spend more time on injun nets..Instead of trees it looks to me like the fish are disapearing WAY faster then timber..
As far as the electron dam goes it is operated from a flume. There is NO dam that crosses the whole river...It is totaly seperate from the main river.

Jayjos, Treaty tribes fish the areas they are legally entitled to. Hatchery fish are included in their allocation. If you want to increase your understanding of how and why this occurs, read U.S. v. Washington, known as the Boldt Decision at www.ccrh.org/comm/river/legal/boldt.htm The court found that the state and federal government developed and operated salmon hatcheries to offset losses caused by overfishing by non-treaty fishing, not by Indians, since the state generally did not allow Indians to fish according to their treaties. PSE put up one half the money used by the Puyallup Tribe to build a fish ladder at the Electron dam. I think the SURF Board provided the other half, which is a mix of state and federal money. The real question is why didn't PSE pay the full cost? It's their dam. And Timber Man, yes, PSE has a diversion dam across the upper Puyallup River. That is how they get the water into the flume that leads to the hydro project powerhouse. It's worth noting that PSE has no fish screens on the diversion flume, and monitoring by the Puyallup Tribe has found that the project illegally takes ESA listed chinook salmon and bull trout. The type of turbine at this project has zero fish survival. We'll probably be hearing more about this in the near future. Sincerely, Salmo g.

Hey Timber Man, What's up with the racial slurs man? This Injun is Pawnee, Plains Indian. Therefore I have no rights to fishing. Which means I buy a license just like everybody else, and I have to follow the same rules you do. So I'd appreciate it if you'd think before you post any more radical statements about Injuns! Ken

Every group contains a few scum bags. Some folks just tend to focus on the scum bags and let them represent the group. Those folks usually make up the scum bags of their group - usually (sometimes emotions and other things temporarily cloud good judgement...).
Try not to take it personally.
