Actually it was a presidential mandate from what I read, which is law, but no a congressional law. Internal Military issues should be delt with by the military in my opinion. I'm not advocating for the military to ignore the law, or a police state. For you to suggest that is just stupid. In a volunteer military, I think they have a right to discriminate if deemed necessary. They do presently with health issues, education etc. By forcing the issue, only for political purposes, opens the door for possibilities, although remote, of vision impaired, mrdd, or any other group that doesn't want to be discriminated against as recruits. I see it as a slippery slope. I'm in no way saying gays shouldn't serve, but I do think the issue should have been handled internally from the start.
There should be nothing that has anything remotely concerned with the Constitution that should be handled internally by the military. The U.S. military is NOT exempt from U.S. law, nor should they govern themselves in any phucking way. The military is part of the U.S. government (despite what many neocons believe) and should be contained as such. They are, after all, funded by tax payers (and China) and are not a sovereign entity. Hitler and Stalin, and most dictators for that matter, came to power because the military became the most powerful political party. This is why we have laws against martial law.
I think anyone who can pass the physical and mental evaluations and wants to serve in the military should be able to do so. Anything less is against the spirit of the constitution. About time the law of the land meets that standard in my book!
And anyone who thinks gays in the military have not been discriminated against in the past doesn't know history very well.
There is a reason that San Francisco has such a large gay population. That's where the Navy dropped them off on their way to fight the Japanese in the Pacific!

Anybody willing to volunteer for military service earns a beer from me any time I'm around. I could care less if he/she likes the same sex for a partner. Get the job done. What you do in your off time I don't need to know about.
