so i was coming home from the lake today, way too many people there, i was agitated, put my rods and gear in the back, hopped in the passenger seat, and left... i was litterally 1/4 mile or less from the lake, crossed Meridian, into the mall parking lot, and then the lights came on from the Stater behind us... we pull over, and he walks directly to my door, not my girlfriends door whome was driving... we were in a parking stall, so there is no reason to not have gone to her side for safety reasons, but thats irrelevant... what is relevant, is he walked directly up to me, said "you are being recorded by audio and video, do you understand sir?" i replied "yes sir"... then, he said, "is there any reason you arent wearing your seatbelt?" my response, "i just left the lake, and kinda forgot for a second, as my phone just rang while pulling out"...124 dollar ticket.. no warning, just here, see ya later....

so, ive scoured up a little info so far, but, i always thought that police didnt have the right to pull you over for not wearing a seat belt, i always thought they needed a primary infraction that they could do that, what ive found so far, says exactly that... the article was written by some news paper, and not the police, and i understand that, but, i cannot find anything in the RCW that states that they can pull you over for that infraction alone...

is there something im missing? or am i correct in thinking that it technically wasnt "legal" for him to do what he did? i appreciate cops very much, am always respectfull, never been arrested or taken to jail, but this is kinda messed up...i dont have an extra 124 dollars right now and cannot pay, so my only option is to go to court, and see what happens there....

so, was he in the right? do i sell a rod or 2 to pay for this? or should i go fight it in court because he legally couldnt have done what he did?

any help is greatly appreciated, no stupid comments please... thank you...

oh, and he hit the lights in the mall parking lot, NOT on SR 161 which is Meridian Ave in Puyallup... is that even legal in itself?

Washington State Seatbelt Tickets




Under Washington law, failure to wear a seatbelt is a primary offense. This means a law enforcement officer may stop a vehicle if the driver or an occupant is not wearing a seatbelt.

Drivers and Passengers Sixteen Years and Older
Failure to wear seatbelt infractions are not limited to drivers alone. Any driver or passenger who is sixteen years of age or older may be issued a failure to wear seatbelt infraction. Any person who is issued an infraction will be responsible for the fine.

thanks RvW, did that become primary after July 1st 2002? i cant find any RCW law that says they can or cannot do it?

is this worth me even going to court? will they even cut it in half like usuall, or should i just eat it?

when did it become a primary infraction tho? is that article i posted not relevant? i know cops are cops, and can do what they like, but when has it been legal for a cop to pull you over in a private parking lot, for a traffic violation? like i said, we crossed 161, didnt travel down it, its 4 lanes wide, and out of nowhere, 150 feet from the street, he appears behind us... in a parking lot... if i have to pay, i have no problem doing so, it was my fault for forgetting for 1 minute... i just dont see how its fair, there are people speeding down that road all the time, and you NEVER see people pulled over really... it just seems to me like he was looking to write a quick ticket, and i was the lonely sheep that wandered out in the open... ive given enough of my damn money supporting the WSP and KC police departement in donations, my girlfriends uncle was Norm Maleng, as if he didnt do enough for the state... i cant even get a warning in a god damn parking lot?

her other aunt and uncle are FBI agents, so its not stretching it in any way... the cop didnt even want to see her lisence... uhhh, she was driving, how would you know if she was legit, had warrants, was a killer, or anything?

i was singled out, for some reason, and it doesnt seem fair to me... and i CAN pay the ticket, i just dont have 124 bucks to be throwing around like im in Vegas...

as far as your other idiotic comments, she goes to school full time, and wanted to go to the park there, so i said sure, i can mess around and throw some spinners... i also have only kept 2 trout from there, both 5 pound trout, and they ate just fine, on the BBQ...

I got a speeding ticket, went to court and because I hadn't had a ticket for over 7 years, I got a deferment for a year. If I got another ticket, the speeding ticket would be enforced. If not, the speeding ticket would be removed from my record. What they would do with a no belt ticket, I have no idea but if you do go to court, the judge may cut you some slack, cut the fine or dismiss it. The only thing you know for sure is if you don't go to court, you better pay the ticket. You might be able to make payments if you do have to pay.

Stater has you cold. You were on a public road before you got into the parking lot. Where teh stop occured isnt the issue He got you.

Got pulled over for a dirty license plate on my utility trailer in McCleary by the new cop in town yesterday. Really? Mud from a pothole Hunter gets to fix got on it. He did the usual license & registration, verbal judo, etc., like the new guy trying to make a point. I asked him if he was going to carve me a ticket, and he said "no". I told him, "Nice pretext stop." Attitude go a little more stern at that time. I Iaughed at him, told him to relax, and then told him to talk to the other officers (friends of ours) so he would we were not the bad guys in town.

I did clean off the license plate when I got home.

i know this isnt a big deal, but i mean come on, in a parking lot? i would have put the phone back in my pocket, and seat belt on... its not like me not wearing a seat belt will hurt anyone else anyways... but it is the law, and i know that, but how far do you push the law? because guarenteed some fat titted blonde chick got pulled over 5 minutes ago by the WSP on the god damn free way, and got a "this is a warning maam, please put your seat belt on"... but no, this dipsh!t that thinks too much about stuff he shouldnt think that much about, forgets something, and since i dont have any [Bleeeeep!] that are relevant to him, i get the ticket... its all good, cops are cops, and are just doing their job... they dont write the laws, and theres no reason for me to be mad at them, what im mad about, is how it went down... just dont make sense...

Blue, when around people that can screw your life up (law), and are worth more money than everyone you knows family combined (clients), im the most respectfull person on the planet... what im planing to say, is :

If you go to court and don't say anything but what is in the last line of your last post, you might get cut some slack. But if you bring up any of the other irrelevant sh!t you've been filling this thread with, the judge might see if he can raise the fine just for you being as stupid as Abu is calling you.

Learn the difference between relevance and irrelevance. It will save you a lot of time, and you won't appear as stupid. BTW, life isn't fair. Get used to it. Oh, and wear your seat belt dipsh!t.

Last time I was stopped was for no front plate. I asked why the camera man and sound man were filming, cop says for training purposes only and not to worry about it. When he was done with me the camera guys said they were crew from the Cops TV show, but they did not need me to sign a release as there was nothing worthy of putting on TV. Damn, missed my big chance to go down/up in flames.

If you go to court there is no gaurantee that your fine will be reduced. The Judge could raise it to accomodate your immature attitude. If you really want some decent advice I would check with proper legal aurhority. Some lawyers will give you a couple of minutes on the phone.

jesus Chuck, why so harsh? i ALWAYS wear my seatbelt, in case you didnt know, i was in a wreck Nov 14th of 1996, with a person who decided to drag race in the rain... we hit the wall, a 15 foot Granite and Basalt wall, at an estimated 130+ MPH by the WSP on SR900 in Renton...i put my seatbelt on about 5 seconds before we hit...i always wear it, i just forgot due to alot of sh!t on my mind... its nothing to do with lazy... and, after the fiasco last year Koke fishing, i always wear a PFD now, regardless of what someone else thinks of how i look...

now that i think about this, its actually rather funny...wonder if i should wear a pin stripe, or just jeans... havent been to court in 10 years, kinda weird...

Chuck, i wasnt driving... i was the passenger... i fVckin forgot for litterally a minute or maybe even 2.... when i am driving, i put me belt on just like you do.... i dont have any problem owning up to anything.. you know my name, run it through Washington Courts Search, and you will see my vast criminal record....

what i do have a problem with, is the situation of how and why we were stopped...and the fact that i didnt see him, and he appeared right behind us, in a private parking lot... if he was sitting in the bank, while i pulled in and passed him, (how he could have seen that i didnt have a belt on, and i didnt see him is beyond me) i wasnt on the road when he pulled us over.... cops can do what they want yes, but other people in this thread have stated the parking lot situation just like i have...


fVck it, im going to court... ill wear the pin stripe suit, and the Ness 1980s era Hawks hat, both the earrings in, and JUST BE ME.... theres a reason ive never been to jail, or really in trouble in general, and thats because im ME..

Recently I got a speeding ticket with my 12 Y.O. grandson in the car. I was polite to the officer, accepted the ticket graciously and went on with my day.

As I explained to the grandson, when you break the rules there are consequences.

If you work, you can choose night court so you don't have to take vacation time.
My advice is mostly the same already stated. When in court, dress appropriately and be respectful.
If the ticket amount is difficult to pay, tell the judge that. Don't make excuses. Tell your "I simply forgot" story, then shut up.

It would cost me more to miss a half day of work if I were to go to court than it would to just pay the ticket. I got a speeding ticket by one of those cameras, could have done the whole "prove it was me driving the car" thing to get it reduced, but I was guilty so I just paid the ticket.

since when does forgetting something for a second, and being upset about a rather large ticket for something stupid, equate to me never learning, or wont, or cant? appearently some of you dont wont or cant learn either...

1, i asked for no stupid comments

3, that is my ONLY traffic ticket in the last 10+ years, probably more like 12+ as i cant even remember the last time i was even pulled over...

i went to another lake today, seat belt worn just like always, even with thinking about a bunch of other crap... now, i highly HIGHLY doubt that the people bashing me, have NEVER forgot something, went 2 miles over the speed limit (which is illegal you know), went through a yellow light, not fully stopped at a stop sign, or anything of the sort... so dont act like your all high and mighty...i made the mistake, but the price is rather absurd, and upset me,.... there something wrong with that? you all always happy with everything that gets dished your way?

and as far as me learning, you know nothing about me, ive forgot more than i already know, and learn something new every single day... just because you cant read and interpret things correctly, is not my problem...

to the others, thanks for the help, i think i will go to court and explain what happened, and say it will not happen again, and like i said before, just be myself, because people like me, maybe not on here, but i dont really care about that... i have plenty of friends that will tell you otherwise....

it says right on the ticket: "This is a non criminal offense for which you cannot go to jail"..

i know how to talk to people, i know how to be respectfull and talk tactfully and with couth... i learned that working for my dad talking to home owners that are worth more than any person i knows family combined... like the CFO of Microsoft wink

all i have to do is talk to the judge, the exact same way, and i will be just fine... also, my long, vast criminal history, should help that out quite a bit too...

thanks for making me laugh tho guys, that ticket pissed me off price wise, now, its actually pretty funny, im not worried one bit...

this should actually be pretty easy, as ive never once gotten in trouble in Pierce County, my tickets and other crap was all out of King County, with the exception of 1 in Grant County... in my 33 years on this earth, i think ive gotten like 4 tickets... 1 of which was a 186 dollar ticket that i got cut down to 50 just because i know how to talk to people wink...

its all good DD, i was just flippin ya sh!t, but if i go to jail for 6 months for forgetting to put on my belt for 1 minute.... all i gotta say is, if you think i ranted here, just wait for that post if that happens grin

oh dont get me wrong, i dont want any sympathy, it was my fault, i know that...

but 124 dollars for no seat belt? its 124 dollars for not having current registration, which is worse? if you dont have current registration, your insurance is invalid... same without having a valid drivers lisence... while not having insurance is a ticket (and a huge one) in itself, why is it in the same class as no seat belt?

probably the same reason that Marijuana is in the same class as Coke and Heroin, because the law makers say and do whatever they want...

just to get this straight, i dont have problems with police in any way, and no, im not a perfect person, ive done some things that are wrong... truthfully, ive been handcuffed several times... several, as probably 10, maybe more... yet, ive never been arrested, never been to jail, and have 4 tickets on my record... total, in 33 years...

2 were for weed (small amount, like a joint, and i dont care about your opinion so keep it to yourself)

1 was for running a red light (i inentionally did it, smoking the tires all the way through, and had the ticket cut by nearly 75 percent, because im smart like that and truthfull)

and 1 for no seat belt....

my handcuffing incidents, were due to people messing with my family, and i dont play that sh!t... in the end, they got their a$$ whipped, pissed their pants, and i went about my day... and they were all when i was hanging around people i shouldnt have been around... since my dad died, i havent been in trouble once, wellll, maybe once, but that was because some a$$hole decided to call my mom a bunch of names and i said i would knock his teeth out... he called the cops on me, and the cops came here and said "sir, you cant be threatening people like that", i said "yes i know sir".....


have a good night...


he wasnt here 30 seconds...

other than that, i talk to em about people stealin stuff here when they come through, talk to em about guns at the store when i see them, and am respected and talked to like a normal person each and every time... because i give them respect, and i show it.... they have it hard enough, and they dont write the laws, they enforce them, cant get mad at them...

i also help the WDFW with atleast 50, usually more, tickets written per year... just by me alone...

police are just doing their job, they dont write the amounts or laws... its far above that... and i dont agree with it... but i will have to deal with it, or go to jail for having no mudflaps on my truck... stupid stupid things people get in trouble for... but, its the law...

actually Hank it was smart, heres the break down of that:

i went to the store to grab some beer one night, when i walk in, theres 3 little (taller than me) punk phucks in the store, 2 of em say "gimme 50 cents"... my reply "fVck you, make me give it to you" they go of with the "aight then, blah blah blah"... im like whatever... they leave, i get my stuff and go out get in my truck... when i shut the door, theres now 5 of them by the side of the building, talkin a mess of crap.. im still like whatever, say basically FU, do something about it... so i pull out on SR900 in Renton, and am sitting at the stupid red light at midnight with ZERO damn traffic out... and they come up to the corner bull rushing my truck... so i slammed on it, and smoked the M/Ts right through the red light...


little did i know, 200 yards down the street, there was a RPD police officer coming my way... he pulled me over, and said "is there a reason you ran that red light driving that way sir'? i said "yes sir, did you see the kids on the corner" "yeah", "they demanded money from me in the store there, and i refused, and they charged me, so smoked em", "im sorry officer"..... well, that didnt work out, he gave me the 186 dollar ticket and went after the kids...

so i go to court....

female judge.....

i tell her after telling the bit of the story quickly "maam, yes i did do it, but, it was either that, or i get into a situation with teenage kids, since noone was around, i thought it was the best option... im sorry maam, it will never happen again.."




bam, reduced to 50 bucks,

i did it, i admitted it, i was myself, truthfull, tactfull, and hell, even cute...

dont ever doubt me..

and Abu, yeah, 10 or more, dont mess with my family, or that number may increase....
