What is unclear from the report was if she said "no" at all while she was awake. If she did at any single point, he's toast for standard SA. Additionally, I'm certain a rape kit was administered. If it shows anything it must have happened after she passed out. If that's that case, then we are talking rape rape and no longer standard SA.
