Is there really any difference between, a search, investigation, compliance check, safety check or welfare check? specifically when conducted by state or local officials/employees in any capacity.

In any context of any application related to these adjectives, what is the purpose of their implementation? To advise, gather information about the regional population and the individual so the government can better serve the public. Is that why?

Is it to empower each of us as an individuals by advising us on things, inspecting us perhaps? Is it possible that information gathered assists each individual to feel more in control, responsible and or independent?

Is it also possible that all of these perceived processes can be used to penalize, dominate, fine, re educate and or monitor. Can these non law enforcement agents, enter your home or upon your property under "community care taking" or in an administrative function and then use information or evidence which they have witnessed against you? Does that ever happen?

Are people from the Health department, building department, CDC, CPS, Department of education exempt from 4th or 5th amendment limitations when they function as the long arm of the law? Do they always function as the long arm of the law by legal mandate? Do these individuals have a legal duty to report crimes which they are witness to while advising, inspecting, is there a real possibility that they may report things that they witness or see, to law enforcement who then can use that information as "good faith" from a "credible Source", to then seek a search warrant or arrest affidavit, or take away rights....


Just wondering what you all think? Do you think that it's possible that these administrative functions could jeopardize your right against warrantless search, or self incrimination? Because your property, home or dwelling and your curtilage or even your vehicle or boat is an extension of you, regardless if you own it or not it affords you the same protection under the constitution as your person has....

So truly what are all these processes for, why do all of them seek to diminish the power of the constitution, and remove self empowerment, self governance and independence.... The purpose of all of these seems to condition you of the idea that we as individuals, are not smart enough to manage our own lives...

If your in your boat, out on the water different laws apply and you don't have all of the same protections.

I had another point,

Is this administrative authority, which is what it is in most cases, only in effect if the individual recognizes it and submits to it, therefore he presumptively gives up his constitutional protections by merely participating or being compliant...

Can you re-invoke your rights at any time?

Are you considered non-compliant, or even passive resistive if you wish to exercise your rights?

From my trainjng and experience, if any of these processes or functions conflict with a reasonable expectation of privacy it is considered a search by definition. It's said that it's important and considered wether society would recognize that there should be an expectation of privacy within any given set of circumstances, so apparently comman accepted practice within the current context is a factor regardless of constitutional application.

My interpretation would be if any governmental process has to do with an inspection, review, audit, search or investigation, of your persons or property and you feel you have an expectation of privacy than you are protected unless you waive your rights voluntarily, or you are served with legal notice.

I'm surprised no one thinks about this, yes I understand that as long as you wish to maintain certain privileges you are expected to submit, but is that truely reasonable or necessary.

What's most important about being an American citizen? Just existing and conforming to comman acceptable practice? or is it more important to assert your rights..

Not true Salmo,

Those rights are inalienable. You have to recognize and accept, invite it for any subsequent laws meant to degrade your rights to be valid.

There are ways to not be subject to some of the constitutional violations such as not having a cell phone, using cash instead of credit and debit.

Problem is if you want to participate in many things you have to give up your rights, because what is natural law and basic human rights have been purchased.

Cell phones are really nothing more than intelligence gathering devices, tracking devices. They give us convenience but we give up much to have them.

I highly recommend going old school if you can and just using a land line. I have been cell phone free since 2012, after the panic wears off of not having it you start to relax and wonder why the hell you ever had one, makes life much less stressful and you worry much less.

I had two cell phones 24/7 before that, cop phone and personal, now I have none. You won't die if you don't have one infact you will be much happier.

Had another thought.

how can a crime be committed agianst the United States Government? Who\what is the united States government?

How can the united state government takes rights from you which they did not issue/ grant? You were born with your rights, it's not like you are issued your rights by the government on your first birthday.

I don't ever remember signing a contract as an inhabitant born in this country, with the United States government giving them the right to take my rights.

You know the constitution does not grant the people rights and privileges, it restricts the federal government, and makes clear that the people and the states have the power, You were born with the rights they were never granted to you, none of us unless an elected official or in the military ever have entered into a contract with the Federal Government granting them the power to takes rigts. So how can they do it?

Not true ColeyG, you have the power and you don't even know it. You need to read the constitution. It's your natural born rights which the Constition protects by limiting government, and framing\limiting the branches. the people self govern, the government is to look out for our interests and our national protection, nothing more.

I've spent plenty of time reading the constitution and the modern interpretations and applications thereof Rich.

The constitution is a product of man who is fallible and flawed. What rights did those born before the constitution was written have?

OK , I believe the creator gives you your rights, it's up to you as an individual to assert those rights, the constitution puts limitations on government. The constitution does not limit the power of the individual.

the bill of rights was written\added not to grant the rights. every human has the same rights, does not matter where in the world they are, they are born with them. The population in these other countries could never unify to agree on limiting government, they chose enslavement instead.

In the new world, man governed himself, but also saw the need of a limited federal government, to do things in their interests, but to not rule them in any way whatsoever.

None of this has changed, but the intentions of government has changed. the government here eventually seeked to enslave, which we have let them do voluntarily. the government creates "privledges" and then trades, for your rights. the government convinces you that you need these privledges but you have to give your rights up to get them.
