McCormick & Schmick's settles with woman who found condom in her clam chowder

SEAFOOD.COM NEWS [Associated Press] - January 13, 2004 -SANTA ANA, Calif. - Four women have resolved their lawsuit against a restaurant where one of them allegedly found a condom in her clam chowder, attorneys said Monday.

The women had sued McCormick & Schmick's Seafood Restaurant, claiming negligence and intentional infliction of emotional distress after one bit into an unwrapped, rolled-up condom on Feb. 26, 2002.

The case was scheduled to begin Monday in Orange County Superior Court but was canceled after the two sides reached a resolution. Details were not released.

'The case has been resolved in its entirety,' lawyers for both sides said in a joint statement Monday. 'Both sides are happy with the outcome.'

The women said they were all eating clam chowder when Laila Sultan, 48, bit into something rubbery. Defense attorneys previously said there was no evidence suggesting the Irvine restaurant put the condom into the soup and were at a loss for an explanation.

McCormick & Schmick's, a privately owned chain that owns 42 upscale restaurants in 19 states, sued the company that supplied its clams. A judge ruled in favor of the supplier last September.

What a hoot! Do you suppose the out come of the settlement would have been larger if it has been geoduck?

I gotta have my doubts about that being in the chowder before she got it served to her table.

It would be pretty easy to slide something into your food and cry "I'm gonna sue" and drive away in the brand new car that ya get out of it.

Betya it has been done before with something else put into the soup. IMHO

I love Clam Chowder and will continue to eat it.

Now. If I can find my red Gooie-Bobs I think I'll head to town for some spagetti. I need a new rig.

I worked at a bar in college. When the sorority girls would get snotty with one guy i worked with he would use a prticular part of is body as a swizzle stick to mix her drink. If these woman copped an attitude with the staff It would not suprise me at all that something would show up in their food.

Worked in restaurants for about 12 years before my desk job.

Rule 1, most of the time is alright to send back your meal once if it's not cooked to how you like. Rule 2, if you send back your food more than once your asking for it from the chef. I've seen everything from spit into the fett sauce to steaks being dropped and kicked around on the floor, then ran through the dishwasher, then plopped into the au jus bucket, and then returned on the plate . So beware.

My best clam chowder story is from a local seafood restaurant that I used to wait tables at, one time a lady came in, ordered a cup of chowder and proceeded to chew on what she thought was a tough clam, she delicately spit it into her napkin and then realized she had been chewing on a used fabric band aid . The prep chef confessed to noticing the band aid missing on his finger after he made the chowder the previous day, but he figured that it just fell on the floor somewhere.

How could you possibly have a spoonful of chowder with a condom in it and NOT know that it was a condom? mebbe it was a really small one!
