There’s false advertising on an OP guide’s web site (not Bob’s). I recently found that a picture of me and my wife holding a bright summer king is posted on an OP guide’s web site as his main advertisement! I don’t know who this guide is; we’ve never fished with him before. We caught the fish with another guide service. How do you think I should handle this? It’s false advertising at its best!

If someone else has the rights to the photo it's possible that this guide may have received permission to use it. If you know that another guide service has the rights to this image you might contact them first and find out what the story is before you do anything else. If there is a problem they will probably want to resolve the issue for you especially if they did not get a model release from you. If they can't help you, then you might have to send this guide a certified letter or email cordially asking him if he has a model release or the rights to use the photo as you do not recall ever booking a trip with him or giving him permission to use your image. That should get his attention and prompt some action on his part to either inform you of his standing or to take it down toot sweet. But if you did sign a model release and permission was given then you have no say on where your image appears regardless of how the image is used.

Hard to believe that anyone would actually give a wrong impression for the sake of a buck, eh? Happens all too often. What you see is not always what you get.

It is probably the web designer not the guide. Although the guide would have ultimate approval authority.

Email the webmaster of the site an indicate your displeasure with the image usage. I would ask him to "cease and desist" from using unauthorized use of your image on the site and any other associated sites. Many times one site will redirect to multiple other sites. I would put a bogus atty name in the CC: on the email. Indicate that if the image is not removed you will have no other recourse than to continue to seek other legal avenues.
I can almost assure you it will be removed \:\)
Probably more of a easy to snag a picture and post than than to have an intent to fraud.
I have built many sites that are Jeep related. I found a picture of one of my custom Jeeps on a site in Germany...!! But I thought that was pretty cool LOL
Email me if you need help, there are other ways to deal with this issue as well.

What's all the fluff? Are you two naked? Famous? Does the guide say that you have fished with him?.....or does he just post a picture of a couple of people with a fish or two?

If it were me in the pic, I'd be flattered and probably tell my friends that I'm on the web and that I haven't got a clue who the guide is, but the pic is cool.

Maybe you should just have posted the link, so we all could go enjoy the pic. I suspect with a public denial that you have had anything to do with the guide will/would be good enough for the web site to have your mug shot removed.

I'd email the guide and ask for a free ride down the river since he's using you for advertisement. He might happily agree.

If he refuses, I'd demand that he remove the photo.

Upon investigation you might find that the guide you fished with and the guide posting your pic are now partnered in some fashion. This is a pretty tight business and at one time or another they've all worked together in some form. When Bob (or any other guide) get's too many calls, he will send business to another guide, etc, etc.

Thanks for the replies. I was not bent out of shape but was flattered with his use of the picture, but at the same time thought is was misleading to the general public. I think guides should post pictures that they actually were involved in. In this case another guide deserves all the credit. I have not posted the link to the picture because I mean the guide no negative publicity, particularly if it’s the webmaster that posted it. If he wants to give me a free trip, great. And no, we were not naked.... this time.

As a professional photographer I on occasion find one of my photos used without my permission.

I've found over the years that a pleasant but direct letter to the individual or company that used the photo without my permission is the best way to handle this.

You might point out that although your were flattered to see your photo on the website, that you have never fished with him and feel it is a misrepresentation.

Suggest to him that as a courtesy, he might host you and your wife for a trip with him, if not please remove the photo.

Im my case, I just send an appropriate bill. Never had I have had it ignored.
