Seattle gun ban over turned. SEATTLE - A King County Superior Court judge ruled that the city of Seattle ban on guns on city property is illegal, effectively ending the ban.
"It shows how strong our case was," said Alan Gottlieb of the Second Amendment Foundation. "Politicians in Seattle have to get over their anti-gun bigotry and realize that we have certain laws and protections and freedoms in this country, and they need to stand up and protect them, not attack them."
The Second Amendment Foundation, the National Rifle Association, and several individuals, including a gay rights activist and a Department of Corrections worker, sued the City of Seattle and former Mayor Greg Nickels in October. They demanded the city repeal a controversial ban on guns in places like parks and community centers.
The individual plaintiffs say they're suing not just on principal, but because they now "fear for their safety", according to their lawsuit.
King County Superior Court Judge Catherine Shaffer issued the ruling Friday afternoon after the plaintiff’s filed a motion for Summary Judgment and prevailed.
Mayor Mike McGinn has supported the ban, and was eventually named in the lawsuit instead of Nickels, said Gottlieb.
Late Friday, McGinn issued the following statement:
"I am disappointed in today's ruling. Cities should have the right to restrict guns in playgrounds, pools and community centers where children are present. The court's ruling was based on a state law, RCW 9.41.290, which preempts Seattle from regulating the possession of firearms. It's time for the state Legislature to change that law."
One example used by those who pushed for the gun ban -- a May 2008 incident where a man shot and injured three people with one bullet at Seattle's Folklife Festival.
Two of the victims in that shooting, Sarah Thorsnes, 22, and Josh Penaluna, 20, spoke out today against the ban, saying they believed the ban was more about politics than public safety.
"I'm very glad there are enough smart people out there, and not let some selfish politician get his way," said Penaluna. "There's nothing you can do about someone who's going to shoot you from the back."
According to the judgment, the city must stop enforcing the gun ban by Feb. 17. They also have 30 days to take down the "No Guns" signs posted at parks and community centers around town.
"We will comply with the court order, and we're weighing our client's options for an appeal," said Kathy Mulady with the Seattle City Attorney's office.Yet another case of politicians willfully volating the rule of law. Who would be so stupid as to continue to vote for ass clowns who would be willing to set aside the State constitution? Wake up folks. Follow the law.

It all boils down to how we think a free society should operate.
If my neighbor has let his lawn and property go to hell and it bothers me that much I may knock on his door and ask if there is anything I can do to help. As owner of the property he has a right to do whatever he wants with it. So long as it doesn't pollute or damage my property in any way.
The last thing I would expect is for the local gov't dupes to come in and either force him to clean up or fine him. When laws like these are passed official always cite that "the measure isn't aiming to crack down on residents who are a few days late mowing their lawns", yet there will always be some abuse of the law.
Fact is people are getting lazy and expecting the government to do more and more for them. Don't like the way your neighbors house looks? Move. That or organize the rest of your neighbors to help the property owner out. Is it any wonder that we see this continuing encroachment of liberties in nearly every faucet of life? Any wonder why government budgets continue to rise with no end in sight?

As far as the gun issue goes this is nothing new. I always like to pose gun control advocates with a few simple questions and scenarios. Most people on this board I would assume believe that an armed society is a safer society.
Can you imagine if airline security were left up to the airlines instead of the feds? This way I could chose to fly on the airline that imposes the strictest security standards. Airlines would compete for passengers based on their level of security. Do you think 19 hijackers would have been able to over-run 4 planes with box cutters if the pilots had been armed? How about if there were designated armed air marshalls employed by the airlines on each flight? Those fools would have been shot dead. That little implementation could have saved us thousands of lives and two costly wars.
How about school shootings? What if teachers were trained and armed? How many deadly school shootings would have turned out the same way? Colleges same thing. How many campus rapes could have been avoided with a concealed carry law in place?
Too many times we look to the government to protect us from things we fear when we should be thinking of solutions that can be accomplished on our own.
