FWIW seems like the defense attorney was probably just doing his job. Same as me writing a report, or you sending someone an insurance quote. He has to act that way, accusatory to you, because he is paid to do so.

Seedy bars can be as much fun as classy bars, and I don't think you need to defend your choice in entertainment. There are just as many guys who will hit on your wife at both types.

I also think you acted correctly. Telling someone to f%ck off is one of life's simple pleasures, and everyone should experience this type of thing in-person, not just on the internet.

Now that you have kids, you probably will have to act like more of a pu$$y and that sucks, but now you have to put your family first, and that means keeping yourself out of the hospital, jail, etc. So going forward you will know not to escalate the issues, even if you really want to throw down with the punk (cause it would be fun), its not prudent.

How exactly is our justice system 'flawed' mowsley? Please be specific if you are able.

It is a defense attorney's job to represent their clients to the best of their abilities.

If you have the facts and witnesses on your side... the prosecutor should have no problem obtaining a conviction.

Let's turn it around for the sake of argument though. Let's say you were wrongly accused of committing assault or burglary or some other similar crime.

Wouldn't you want your defense attorney to use every tactic at his/her disposal?

really? well firstly this guy wasnt wrongly accused, he was rightly accused. secondly, when a justice system largely revolving around profit (defense attorneys, civil suit attorneys etc.) creates a situation where criminals go un/under-punished because they have the money to hire that "good" of a lawyer that is a flaw in the justice system. This is a repeat offender, i did some research, the first time this happened, the kid got off because the other kid he was intimidating and belittling pushed him first. Him and another guy beat this kid so bad he was in the hospital for a month. Now do you think that isnt flawed? or is that justified?

well i dont know about MORE of a pu$$y but i get what youre saying. all in all you and M are right. we shouldnt have been there, and it shouldve never occured. But it just really infuriates me that theres a chance he may go under punished for the crime he commited. what 30 days in jail? BFD i have a nice nasty scar i get to look at everyday.

Mowsley... here's the thing that seems to be passin' ya by.

Our legal system is based on the principle of due process and the presumption of innocence. Is it perfect? No. Are there better ones out there? I don't believe so.

If the facts and evidence against him are as clear as you say they are... and the county prosecutor is halfway competent... he'll be convicted.

You might not like our legal system... or even really understand how it works... but that doesn't mean that it is a failed system and you're just gonna have to get used to that fact.

That post of RR's is spot on.

We do have a flawed justice system, though. I just read an article on misconduct by federal prosecutors, and it made me sick. IMO, prosectutorial misconduct is on the same level as treason, and should be treated the same.

Anyway, sorry about your run-in mowsley.

factually, i didnt make the arguement that our legal system is failed. Flawed and failed are two VERY different things. He deserves due process, yes. And he will get it. But that doesnt change the fact that with enough money criminals can and do go un/underpunished. I will see justice served i have no doubt about that. But dont you see how it might upset me a little bit being grilled like i was the defendant? what if you had been in my shoes in the deposition? You'd be singing a different tune. and yes im sure you can say "well i wouldve never been in a situation like that" but just think about if you had, how would that have made you feel.

That's the thing, AM. This article detailed several cases of gross misconduct by federal prosecutors resulting in several innocent people being convited and serving years in prison. Those prosecutors were hardly censured, and only one was even temporarily suspended from practicing law. IMO, the whole lot of them should have been executed. To abuse the power they wield is on the same grounds as treason, and there is nothing more intolerable and grievous than innocent people being imprisoned.

My bet is that after the first execution, the misconduct would cease altogether.

I agree on the system being flawed and imperfect... and I agree that the defense attorney could very well be a bloodsucking scumbag.

I'm just sayin' that it's what we got and all things considered... it's probably the best one out there.
